🌐🔐 EDPO had the privilege of attending the CPDP – Data Protection Day event this morning. Here are some highlights from the discussions:

🕰️ We started with a nostalgic look back at past conferences, marvelling at the remarkable journey of data protection. The 43rd anniversary of Convention 108 was also underscored, a cornerstone in data protection history.

🤝 CPDP was hailed as a crucial platform for both public and private sectors to engage in meaningful discussions on data protection issues.

🤖 The role of Convention 108 in the age of AI was a hot topic. The Council of Europe emphasized the importance of the European Convention of Human Rights in shaping data protection. It was stressed that specific responses are needed to address the expanding realm of AI, while maintaining a strong connection to data protection. A shift towards a more global perspective was encouraged, moving away from ‘Eurocentrism’.

📚 In a fascinating panel discussion, “A Tale of Two Courts: Lessons in Data Protection from Strasbourg and Luxembourg,” recent developments in data protection case law in Strasbourg and Luxembourg were explored. The level of convergence and divergence between the two courts was a key focus. The discussion highlighted that EU law tends to be more rigid, while Strasbourg’s approach is flexible, dynamic, and casuistic. National judges face the challenge of finding common ground amidst this divergence. Notably, it was emphasized that there is a growing trend towards convergence between the two courts.

🌍 Finally, to close the morning, we heard discussions surrounding the Modernized Convention 108. Completing 38 ratifications in 2024, the modernised Convention 108 will enter into force and is expected to open new possibilities to elevate the protection of privacy to a global level also in areas of public security and create a platform for enhanced cooperation among like-minded countries.

Sérgio Abreu

Sérgio studied International and European Law at Nova University in Lisbon. In his master’s thesis he delved into the impact of facial recognition technologies in Data Protection and Privacy in the EU. He’s CIPP/E certified. Sérgio studied and worked in multiple European cities, including Coimbra, Lisbon, Ljubljana, Brussels and Luxembourg. Sérgio was a Blue Book Trainee at the European Commission’s Data Policy and Innovation Unit, where he was involved in the preparatory work surrounding the Data Act. He also worked at a financial tech company and as a trainee at the Portuguese Competition Authority and at the Portuguese Embassy in Brussels. Sérgio is fluent in Portuguese and English and has an intermediate level in Spanish and French.
